As the first company allowed to import cannabis products into Mexico, we are pleased that Mexico continues to take steps to become a leader in the global cannabis industry, said Raul Elizalde, CEO of HempMeds®. We hope that soon there will be more opportunities to develop our activities in this country and help people enjoy the benefits of cannabis products. However, this declaration of unconstitutionality is not the end of the road. Mexican lawmakers must continue to reform the existing legal framework to provide legal certainty for those who wish to consume cannabis or cannabis products.

The Supreme Court has been one of the main driving forces behind the creation of the Mexican cannabis industry. Since 2017, this regulatory body has issued court rulings that have provided thousands of patients with legal access to cannabis products and legal protections for consequence-free use. According to a new Supreme Court ruling, parts of the nation’s health law that prohibit personal use and home cultivation of marijuana are unconstitutional. Mexican citizens can now more easily obtain a license from the national health agency Cofepris, but the industry is still pushing for the full legalization of cannabis and the passage of a law distinguishing marijuana from cannabis.

More than ever, the public in both Mexico and the United States is advocating for the legalization of cannabis. This recent legislation provides expanded access to medicinal cannabis throughout Mexico, and we hope regulators will use this momentum to take even greater steps to make cannabidiol (CBD) and other cannabis products available to all, added Blake Schroeder, CEO of Medical Marihuana, Inc.
